Is Gifting Legal? Is Cash Gifting Legal?

“Is cash gifting legal?” is a question many have asked. The simple answer is:
If you are allowed to get or give a gift in your country, state, province, or territory,
and you are not in fear of being thrown in jail or fined for doing so, then YES.

If you are afraid to give (or receive) a gift, then you probably should not do so. Cash or otherwise.

That number is anticipated to reach more than $15,000,000,000.00 (15 BILLION Dollars) by 2015. (It has by far eclipsed that now in 2019)

And that’s gift cards alone. Not even counting “gift registries”, cash gifting, and all the other “giving” holidays.

Face the facts, gifting is what we do. It makes the giver feel good for helping or rewarding someone,  and it makes the person who receives the gift, appreciative of the thought and generosity from others, affording them the opportunity to more fully enjoy life.
It also fuels the economy.

Cash Gifting is no different than product or card gifting. It’s a gift. The recipient can use the cash for any purpose they see fit. It really is THE ULTIMATE GIFT!

Many countries have established limits on the value of gifts (cash or property) to be exempt from tax liabilities.
In the United States, for example, that limit (exclusion) is currently (2018) $14,000 per individual (donee) per calendar year.  That regulation can be found at IRS.GOV

There is no expectation of something in return (or at least there should not be).

The structure of a cash gifting activity is what differentiates when a cash gifting activity may cross the line.

When such an activity is based on getting more and more to receive a “gift”, (as in get 5, and they get 5, and you get a “gift”) then it is probably based on a pyramid or ponzi type structure that will collapse on itself.
That structure might be prosecuted as illegal, but not the act of gifting itself.

In my opinion, cash gifting is totally legal and even MORE honest than many of the so-called “opportunities” out there.

After thoroughly investigating many different types of gifting activities, the only one that stood out in my mind as totally honest was the 1-up. In this type, you give someone a cash gift (you choose the level of gift). You then would also give that person your 1st signup (1-up) at that level. After that, all your future invitees will gift that level straight to you. But now they would also have to do just 2 things: Give a gift, and pass their 1st person up (1-up) to you. There are no matrices, no multi-level, no fancy stuff, just giving of gifts between 2 people. And never exceeding the amount allowed by law (USA & Canada).

But Beware: Some have Monthly Maintenance or ADMIN FEES. That can be crazy.

So, Yes, cash gifting IS LEGAL, when done properly, and within the legal limits established by law.

I, personally, chose not to join one, not because I believe it is a fraud, but moreover because it was too difficult to convince the people I might invite. So instead of a gifting program, I chose to use advertising, something everyone uses, as my vehicle.

Also, please understand that I am not a lawyer or an accountant. Use your own due diligence BEFORE you get involved with a gifting activity, as the gift you decide to give is a gift. Expect nothing in return, except gratitude.
